Terms of use and conditions

The following general terms and conditions ("Terms"), as well as our Privacy Policy, regulate the legal relationship between you and IMMO Investment Technologies UK Limited or its affiliates ("IMMO", "we" or "us"), including your use of the IMMO websites or related apps.

1. WELCOME TO IMMO!
At IMMO, we help private individuals in particular to sell real estate easily and effortlessly. Our platform and services enable you to evaluate your property, facilitates the transfer process and ensures an effortless process on the seller and buyer side.  

2. THE LEGAL RELATIONSHIP BETWEEN YOU AND IMMO
As soon as you decide to obtain an offer for a property from us and accept these Terms, a legal relationship arises between you and IMMO or the investor cooperating with us (the "platform contract"). This platform contract includes all conditions for the valuation of your property and our service when selling it.
If you decide to sell your property through our platform, you will enter into the required agreements in order to finalise the sale. 

3. USE OF OUR SITE AND SERVICES
When you use our service, you confirm the following:· 

  • You are at least 18 years old.
  • All the information you provide to us about yourself and your home are correct.
  • You have had, or will have, independent legal or professional advice before a sale and purchase agreement can be entered into for your property.
  • You are the owner of the property that you offer us. If you are only a co-owner of the property, you will disclose this to IMMO. If this is the case, IMMO may ask you for proof that the other co-owners also agree to a sale. If you are not the owner of the property yourself, but approach IMMO as a representative responsible for the sale of the property, you must also disclose this to IMMO.
  • All information you have provided to us about the property is complete and correct.
  • If the property is rented, you have provided all possible information about the rental agreement. You will not provide any personal information relating to the tenant(s) without their express informed consent.
  • Sometimes circumstances change. We understand that, and it’s not a problem. But you agree to inform us immediately as soon as there are changes to your place of residence or business, property or existing tenancy during the sales process.
  • We want to enable you to sell the property quickly and easily. For this we also need your cooperation. You therefore agree to make every effort to answer inquiries from IMMO in a timely and accurate manner.
  • You acknowledge and agree that IMMO, in its sole discretion and without notice or any further obligation to you, may suspend or permanently discontinue access to or use of the IMMO websites and related apps.

4. THE PRICE OFFERED TO YOU FOR YOUR PROPERTY
One of our core promises to you is that you will receive a fair and accurate offer price for the property. We determine the offer price in the following steps:

  • We may provide you with an initial price estimate based on the first information you provide to us on our website about your property. We do everything we can to ensure that this initial price estimate reflects the fair value of your property as accurately as possible, but we can only determine a final value for your property through a viewing appointment by an IMMO expert. Therefore, the initial price estimate should only serve as a first indication and does not constitute a legally binding offer from IMMO.
  • If, after an IMMO expert has viewed your property and is happy to proceed, IMMO may make you a purchase offer for your property (“Offer”). We understand that selling a property is a serious legal transaction. Therefore, we will provide you with seven days to consider the Offer before the Offer will be deemed to have automatically expired. IMMO may withdraw the Offer at any time in that seven day period without liability.
  • IMMO has developed an advanced valuation process to ensure that you get a fair offer price for your property, but our process can sometimes make mistakes. In these rare cases, we reserve the right to correct the Offer at any time. We will inform you as soon as possible about any such correction.


5. YOUR PROPERTY IS LOCATED OUTSIDE THE BUYER'S SEARCH CRITERIA
We are currently only looking for certain types of real estate in the urban and catchment areas of Manchester, Liverpool and Birmingham. However, these criteria may also change over time. If your property is outside our search criteria, we cannot yet give you a provisional offer price. However, we will inform you immediately if changed search criteria also record your property in the future. 

6. THE SALES PROCESS AND EXCLUSIVITY
The property sales process in the UK can be inefficient and hazardous. At IMMO, we want to provide you with more certainty. If you accept our Offer, we may provide you with our exclusivity contract, which guarantees for 30 days that IMMO will buy the property at the given Offer price, subject to a successful technical and legal review of the property.Your solicitors will assist you with the sales process, and you should ensure you obtain independent legal advice before entering into any agreement with IMMO or any other party. 

7. COPYRIGHT
The IMMO website, app, and all content and materials contained therein are the sole property of IMMO and/or its affiliates or licensors and are protected by patent, copyright, trademark and other intellectual property rights, and may not be used except IMMO’s express written consent. Except as expressly provided in these Terms or permitted by IMMO’s express written consent, no content or materials may be copied, reproduced, used or distributed in any way.

8. TRADEMARKS
All trademarks, service marks, trade names and logos (the “Trademarks”), whether registered or unregistered that appear on the IMMO website or app (including the IMMO trademark) are exclusively owned by IMMO and/or its affiliates or licensors and are protected by relevant intellectual property laws. You may not use, reproduce or display the or reproduce the Trademarks other than with the prior written consent of IMMO. 

9. LIABILITY AND DISCLAIMER
To the maximum extent permitted by law, IMMO excludes all liability for any direct, indirect, incidental, special or consequential damages arising from your use of the IMMO website or app or for any other claim related in any way to your use of the services we provide.  While we make every effort to ensure the reliability of our valuations and the fair value of our Offers, IMMO makes no guarantee as to the accuracy or completeness of any information provided to you through this website or related app. 

10. THIRD PARTY CONTENT
The IMMO website or app may include references or links to third party websites, resources or content. You acknowledge and agree that IMMO has no control over such third parties and is not responsible for the content or materials they produce, nor will IMMO be liable to you for any damages you incur as a result of your accessing or reliance on such content or materials. IMMO does not endorse or warrant the accuracy of the information contained in such content or materials. 

11. CANCELLATION RULES
You or IMMO can terminate the platform contract at any time and without giving reasons. 

12. DATA PRIVACY
The personal data you provide to us via our website and during the sales process is confidential. The protection of this data is extremely important to us. Therefore, we undertake to comply with all legal data protection regulations in order to adequately protect your data. Further information can be found in our Privacy Policy. 

13. CHANGES TO THESE TERMS
Sometimes the legal situation or market conditions change and we have to adapt these Terms accordingly. In this case, if you have already obtained an initial offer price or an Offer from IMMO, we will draw your attention to the updated Terms as soon as possible.
If you wish to reject the changes to the Terms, you can inform us by email, and we will unfortunately have to terminate the platform contract with you. If we do not hear from you to confirm your agreement, we may assume that you do not agree to the changes and may unfortunately have to terminate the platform contract.  

14. INVALIDITY
If any provision of these Terms is held to be invalid or unenforceable, such invalidity or unenforceability will not affect the validity or enforceability of any other provision in the Terms. Any headings or titles herein are for convenience only.

15. NO PARTNERSHIP
You agree that nothing in these Terms or your use of the IMMO website creates any partnership, employment, or agency relationship between IMMO and you. 

16. COMPLAINTS AND QUERIES

17. APPLICABLE LAW AND JURISDICTION, CONSUMER DISPUTE RESOLUTION
The legal relationship between you and IMMO is subject to the laws of England and Wales and you submit to the jurisdiction of the courts of England and Wales in relation to these Terms.
